Business address: Cunit, Tarragona, Spain
Purpose
The service provider, as the person responsible for this website, makes this document available to users in order to comply with the obligations set out in Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), as well as to inform all users of the website about the terms of use of this website.
Any person accessing this website assumes the role of user and undertakes to strictly observe and comply with the provisions set out herein, as well as any other applicable legal provisions.
The service provider reserves the right to modify any information that may appear on the website, without any obligation to give prior notice or inform users of such modifications. Publication on the service provider’s website shall be understood as sufficient notice.
Liability
The service provider accepts no liability for information published on this website, provided that such information has been manipulated or introduced by a third party unrelated to the service provider.
The service provider’s website may use cookies, small information files sent by the server to the computer of the person accessing the page, in order to carry out certain functions considered essential for the correct operation and display of the website. The cookies used on this website are, in all cases, temporary and used solely to make subsequent transmission more efficient, disappearing once the user’s session ends. Under no circumstances will cookies be used to collect personal data. Cookie Policy.
This website may redirect users to third-party website content. Since the service provider cannot always control the content introduced by third parties on their websites, the service provider assumes no responsibility for such content. In any case, the service provider declares that any content that may contravene national or international legislation, morality or public order will be removed immediately, and the redirection to that website will also be removed, notifying the competent authorities of the content in question.
The service provider is not responsible for information and content stored, including but not limited to forums, chats, blog generators, comments, social media or any other medium that allows third parties to publish content independently on the service provider’s website. However, in compliance with Articles 11 and 16 of the LSSI-CE, the service provider makes herself available to all users, authorities and security forces, and actively collaborates in the removal or, where appropriate, blocking of any content that may affect or contravene national or international legislation, third-party rights, morality or public order. If a user considers that there is any content on the website that may fall into this category, they are requested to notify the website administrator immediately.
This website has been reviewed and tested to ensure that it functions correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the service provider does not rule out the possibility of certain programming errors, or the occurrence of force majeure events, natural disasters, strikes or similar circumstances that may make access to the website impossible.
Intellectual and industrial property
The website, including but not limited to its programming, editing, compilation and other elements necessary for its operation, as well as designs, logos, text and/or graphics, are the property of the service provider or, where applicable, the service provider has a licence or express authorisation from the respective authors. All website content is duly protected by intellectual and industrial property regulations and, where applicable, registered in the corresponding public registers.
Regardless of the purpose for which they may be used, the total or partial reproduction, use, exploitation, distribution and commercialisation of the contents requires, in all cases, prior written authorisation from the service provider. Any use not previously authorised by the service provider will be considered a serious breach of the author’s intellectual or industrial property rights.
Designs, logos, text and/or graphics belonging to third parties and that may appear on the website belong to their respective owners, who are responsible for any possible dispute that may arise in relation to them. In all cases, the service provider has the express and prior authorisation of their respective owners.
The service provider expressly DOES NOT AUTHORISE third parties to redirect directly to specific content on the website. Any redirection must, in all cases, be made to the service provider’s main website.
The service provider acknowledges the corresponding industrial and intellectual property rights in favour of their respective owners. The mere mention or appearance of such content on the website does not imply the existence of any rights or liability on the part of the service provider, nor any endorsement, sponsorship or recommendation by the service provider.
Any observations regarding possible infringements of intellectual or industrial property rights, as well as any of the website content, may be made via the email address shown in the identification details at the beginning of this document.
Accuracy of information
All information provided by the user must be truthful. To this end, the user guarantees the authenticity of the data communicated through the forms used to subscribe to the services. It is the user’s responsibility to keep all information provided to the service provider permanently updated, so that it reflects their actual situation at all times. In any case, the user shall be solely responsible for any false or inaccurate statements made and for any damage caused to the service provider or to third parties.
Minors
In order to use the services, minors must always obtain the prior consent of their parents, guardians or legal representatives, who are ultimately responsible for all acts carried out by minors under their care. Responsibility for determining the specific content accessed by minors lies with those persons. Therefore, if minors access inappropriate content on the Internet, mechanisms should be installed on their computers, particularly software, filters and blocking tools, to limit the content available to them. Although such tools are not infallible, they are especially useful for controlling and restricting the materials that minors may access.
Obligation to make proper use of the website
The user undertakes to use the website in accordance with the law, this Legal Notice, morality and good customs. To this end, the user shall refrain from using the website for unlawful or prohibited purposes, purposes that harm the rights and interests of third parties, or that may in any way damage, disable, overload, impair or prevent the normal use of computer equipment, documents, files and any type of content stored on any computer equipment belonging to the service provider.
In particular, and by way of example but not limitation, the user undertakes not to transmit, distribute or make available to third parties any information, data, content, messages, graphics, drawings, sound or image files, photographs, recordings, software or, in general, any kind of material that:
(a) is contrary to, disregards or infringes fundamental rights and public freedoms recognised in the Constitution, international treaties and other applicable regulations;
(b) induces, incites or promotes criminal, degrading, defamatory, violent or, in general, unlawful actions, or actions contrary to morality and public order;
(c) induces, incites or promotes discriminatory actions, attitudes or thoughts based on sex, race, religion, beliefs, age or condition;
(d) is contrary to the right to honour, personal or family privacy, or the personal image of individuals;
(e) in any way damages the credibility of the service provider or third parties; and
(f) constitutes unlawful, misleading or unfair advertising.
Applicable law and jurisdiction
For the resolution of any disputes or matters related to this website or the activities carried out on it, Spanish law shall apply, to which the parties expressly submit. The Courts and Tribunals of Barcelona shall have jurisdiction over any conflicts arising from or related to its use.
